Digital Society Says Yes to the New E‑ID Law

After the historic 2021 referendum victory against a privatized e‑ID, we helped shape the digital‑political turnaround for the e‑ID 2.0 law. We managed to get almost all of our demands into the draft: the new e‑ID is privacy‑friendly, data‑sparing and secure. It is built on the principle of digital self‑determination. In this article you’ll read why the result convinces us, why we say “yes”, and why we continue to look at it critically.
More than four years ago we pulled the emergency brake with a landmark referendum and prevented a total digital‑political disaster: Parliament wanted to privatize digital IDs and create massive databases. We successfully stopped that and immediately began work on a new solution. Within weeks we forged a cross‑party alliance that demanded a fresh e‑ID approach in parliament.
The guiding principles: a state‑issued ID built according to the concepts of Privacy by Design and Privacy by Default. With “nerd power” we set the digital‑political turnaround in motion, followed it closely for four years, and were able to bring the “e‑ID Law 2.0” project across the parliamentary finish line at the end of 2024.
Digitally Self‑Determined, Privacy‑Friendly, Data‑Sparing and Secure
We have ensured that e‑ID 2.0 is built on the principle of digital self‑determination, is privacy‑friendly, data‑sparing and secure.
Digital self‑determination – From a fundamental‑rights perspective it is a major achievement that digital self‑determination is the core principle of e‑ID 2.0. We decide ourselves what happens with our digital identity. The personal e‑ID is stored as a “data packet” in the wallet of our smartphone—and nowhere else, just like a physical ID sits in a wallet. You choose where to use your digital identity and which data you release. Everything is transparent, traceable and controllable through your phone’s wallet. There is no central log of when and which digital ID data a person presents.
Privacy‑friendly and data‑sparing – Authorities and companies may only ask for data they truly need. For example, an age check only transmits whether a person is over 18, not the exact birth date. That is far better for privacy than a paper passport or a photographed ID, where all visible data are handed over. Equally important for data sparseness is that organizations must destroy or anonymise the data once the purpose has been fulfilled. The state cannot track where a person uses the e‑ID. The system is designed so that different ID transactions of the same person cannot be linked, neither across different organisations nor within the same one. The bank where you just opened an account does not see that ten days earlier you requested a criminal record extract from a government office. The privacy and data‑sparseness provisions go beyond the ordinary Swiss data‑protection law, so the e‑ID enjoys stronger protection than most other applications that handle identity data.
Secure – The most important security point: there is no central repository of ID transactions that could be analysed, stolen or abused. The ID data reside on the secure chip of the smartphone, making large‑scale data loss practically impossible. Another pillar of security: the e‑ID software is developed and provided by the federal government. The code is open source; scientists, civil‑society groups and anyone interested can audit it and even reuse it. The law mandates regular code reviews.
In short: the new e‑ID law combines clever technical architecture with our values of self‑determination, privacy, data‑sparseness and security. That is why we, as “techies,” support it.
We invested a lot of persuasion work to achieve this digital‑political turnaround. We also succeeded in involving civil society and academia in drafting the new version. During the consultation and hearing processes we submitted widely noted statements, presented our requirements prominently in the administration’s participation procedure, and helped set the most important safeguards for privacy and data security. Such extensive participation for a new law is an achievement we want to make the norm.
We were not only heard; we convinced decision‑makers and got our requirements written into the new e‑ID law. The digital‑political turnaround is a success.
We Look at It Critically
In two areas we did not achieve the optimum.
First, the sanctioning of authorities or companies that unlawfully request e‑ID data—or request too much data (“over‑identification”). That is indeed a breach of the new law, but now individuals and civil society must actively report such violations. When a report is filed, the offending organization is placed on a blacklist and other users are warned about the abuse. Our preferred prevention against over‑identification would be a system where every organization that wants to use e‑ID data must register in a central register, and any misuse triggers an immediate suspension.
Second, we do not endorse the online issuance of the e‑ID because that process is vulnerable to attacks and would involve the collection of biometric data. Nevertheless, thanks to our advocacy you can still choose to have your e‑ID issued in person at a passport office, where no biometric data are collected.
The voluntary nature of the e‑ID is a central building block for us, and we have always defended it. Administrative procedures can continue to be performed physically. Changing that would require legislative amendments, which are subject to political debate and could ultimately be challenged by a referendum.
Digital Corporations Would Exploit the Vacuum
Despite those two points, if you want a good, data‑sparing, secure and self‑determined digital identity in Switzerland, you now have the chance to say “yes.” Without an e‑ID law, the log‑ins from AGOV, SwissID (post‑login), Google and Apple would fill the vacuum, because we will still have to prove our identity online in the future (and must). All of those login services store data centrally—either with the state, semi‑state enterprises, or American tech giants. They would all provide less privacy protection, security and transparency than e‑ID 2.0.

Same here. I meant by never worked for me thst balanced channels just by adjusting fees wasnt achievable for me. I'm also not trying to be profitable, so I could abuse fees to try to auto balance as well.
However there tend to be draining nodes and pushing nodes and those will probably never get balanced by fee adjustment.
